2023 Adoptable Rules

These terms apply ONLY to adopts sold after the date above. Failure to follow these rules will result in a ban for future adopt sales and commissions.

General Rules

  • Buyers may not be anonymous. This includes purchasers past the original sale.
  • Buyers are not required to use ToyHou.se (TH), but all adopts will be posted onto my ToyHou.se before sale. If a buyer has a TH account, the adopt will be transferred to them after purchase. I can try to source a TH code for a buyer, if they need/want one.
  • All sales will be done through PayPal. Buyers email is REQUIRED so an invoice can be sent.
  • Buyers may change an adopt’s sex and/or gender.
  • Posting the original adopt art requires a link back to me.
  • Buyers may change or add an anthro or feral form to the character, if they do not have one.
  • Buyers MAY NOT edit the original art, unless I have given written permission, via email, otherwise. All edits of the original art should be done by me. Failure to follow this rule will result in the buyer being banned from future adopt sales.
  • Adoptable Characters may not be used in hateful content. This includes homophobic, racist, sexist, and ableist content. Breaking this rule will ban a buyer from all future sales.

Re-Selling Rules

  • Re-sold adopts must follow my adopt rules. Potential buyers should have this page linked to them. If a buyer has not seen these, the original buyer will be banned from future adopt sales and commissions.
  • Buyers must contact me before posting adopts for sale. I may be able to buy them back, but I will, at least, help promote your sale.
  • Buyers may not re-sell adopts for more than originally paid for, unless art or writing has been added to the character.
  • Re-sold adopts need their information passed along to me, so I can update information. Additionally, if the new buyer does not have a TH account, they should be passed back to me, and I will hold their character page until the current owner has an account or re-sales the adopt.
  • Adopts that are traded or gifted to other users are SUBJECT TO THESE RULES AS WELL.

How to Buy

  • Buyers should EMAIL me at delphin.arts@gmail.com. I will not accept contact via any method other than email for adoptable sales.
  • Email text should include a link to the adoptable you want, your name on FurAffinity/Toyhou.se, etc, and your PayPal email, even if it is the same as the one you are emailing me from.
  • I will send an invoice to the provided PayPal email.
  • Buyers have 72 hours to respond to invoices. After this, the adopt will go back up for sale, and the prospective buyer may be banned from future adopt sales.
  • Once the invoice is paid, I will email a .zip file to the buyer with the adoptable’s files.
  • Adoptable files will usually include a large, “working size” PNG file at 300 DPI for personal use, and a smaller, watermarked PNG or high quality JPG file at 96 DPI for reposting online. Do not repost the full sized file online! If I see the full size posted online, I will contact the buyer to remove it/replace it with the proper file. Failure to do so will result in a ban from future adopts.

2023 Commissioner Information

This is ONLY for commissioned art. Adoptable characters have their own post.

Customers must be 18+ years of age, regardless of content. This is a legal requirement. I will not accept commissions from customers under 18.

 

For a regular commission, I will need:

  • Clear, concise references, preferably as a character sheet, are required before I give a quote.
  • I will not accept written character information. I want no more than 3-5 images, per character, as reference, though you’re welcome to make a collage of your favorite parts from various images. If you need a way to do this for free, please check out a site like PhotoPea. It runs in your browser and is nearly as fully featured as Photoshop.
  • If you have no visual references, and cannot provide other reference images, there will be an additional fee for character design, and I will need you to be willing to quickly respond to emails. I strongly recommend getting a basic reference sheet before commissioning me, even if it’s a free base that you filled colors in on.
  • Please warn me if any of your reference images are NSFW, even if your commission is NSFW. Commissions will be refused or canceled on the spot if I am not warned.
  • Willingness to provide proof that any characters that are not yours and you want me to draw are okay for you to have drawn (such as the character’s owner having you linked in their FA profile).
  • Email for invoice purposes. I use PayPal only.
  • Proof you have read my ToS (it’s on this page).
  • Willingness to comply with communication over email.

 

For Reference Sheet Commissions, I will additionally need:

  • Prompt response over email, and/or Discord chat in my server. I will set up a private, one-to-one channel where I can later save the necessary information.
  • (For Design Commissions) Commissioner to be willing to join my Discord server, and spend at least an hour with me for character design and laying out relevant points.
  • (For established character commissions) Current “best” images and information about what’s liked best from each image. You may go over the 3-5 image rule for this.

 

Commissioners should contact me at delphin.arts@gmail.com if copies of past work are needed. I cannot guarantee that commissions more than a few years old are still accessible, but you’re welcome to ask.

2023 Terms of Service

Email is my preferred method of communication with prospective commissioners, and I will not start a commission without a valid contact email. I will not discuss details of a commission or accept personal information over any other means than email. Other means of communication are given in the unlikely event that I am unable to access my email.

For legal reasons, I cannot and will not accept commissions from clients under 18 years of age. If a client is found to be underage, they will be refunded and banned from future commissions.

I reserve the right to refuse any commission without reason. This has never happened, but to protect myself as an artist from harassment, I reserve the right to not accept a commission. Refusal to take a commission is not barring a commissioner from trying again, unless I state via email they are otherwise barred.

 


 

What to Expect

I am a fully digital artist. All art commissions will be delivered via email. Commission sale posts will have what you will specifically get, if it is different than the following list.

  • Flattened, working size file, around 300 DPI as a PNG. Should be suitable for printing/personal use.
  • Flattened, “web size” file, around 96 DPI, either as a PNG or high-quality JPG. This image can be reposted, with proper linking/credit, online.

Unless an agreement is otherwise made, you will not receive layered files. Additionally, even though you will be given a large version of the file, you are not allowed to make prints for commercial use. Printing one copy to hang on your wall, or a print-on-demand shirt for yourself is fine, printing multiple copies to sell or give away as a promotion of your online presence is not.

 



Will and Won’t Draws
Please be aware that the Will Not Draw list is not commentary or a moral stance, with the exception of the final item. These are subjects I am not personally comfortable drawing. You do you.

Will Draw (not exhaustive, just preferred):

  • Anthropomorphic/furry characters.
  • Equines
  • Cervines
  • Bovines
  • Canids
  • NSFW/Adult Art/Sexual Art
  • If it’s not below, just ask.

Will Not Draw:

  • Comics/sequential art
  • Underage characters in sexual, violent, or fetish-themed content (SFW is fine)
  • “Musk”/stink/stench, farting, defecation, watersports/urine
  • Human/human faced characters
  • Art glorifying sexism, racism, Nazis, homophobia (in all forms), and/or bullying. Asking me to draw this will get you banned from commissions in the future.

 


 

Turn-Around Time

Deadlines shorter than a month will not be accepted. You are welcome to ask for a completed by date longer than a month from the day payment is sent, and I do try to work as quickly as possible, but depending on my queue (which you will see on this page) and other obligations, I may have to ask for an extension. I will keep you informed of delays/problems/etc.

Commissioners are encouraged to communicate with me about the status of their art. If there are going to be serious delays, I will contact the commissioner directly via email.

To prevent delays, do not ignore your email. If revisions are needed, the sooner I know, the better. Again: All communications will be sent via email.

 


 

Payments

All payments will be via PayPal’s invoicing system. As I use invoices, I require the commissioners email.

Payments may be made in installments, but I require commissioners to discuss this with me before hand. 50% is due before the commission is started. Invoices must be paid in full before final delivery.

Payments are due within 72 hours of invoicing, unless otherwise discussed. Work will not begin until at least 50% has been paid. If an invoice goes past 72 hours without payment being made, and no discussion having happened otherwise, the commission will be cancelled.

 


 

Sketch Approvals

Approval sketches will be sent, unless the specific commission ad states there will be no revisions. Approval or stated changes must be made within 72 hours of email, or the commission will be considered abandoned. Any necessary refund will be issued.

If a sketch is fully rejected, the commissioner understands I may reuse that sketch in a later work.

Sketch revisions/re-draws are limited to three revisions/re-draws before additional fees are charged. Minor revisions are unlimited, within reason. This excludes me neglecting something on the sketch.

 


 

Revisions

Revisions will be provided if I make a mistake, such as missed or improperly colored markings or features (horns, wings, character essential jewelry) that are on the references provided.

There may be times where I am unable to show small details, especially with small/pixel commissions, and commissioners are asked to be understanding of this.

 


 

Cancellations

If a cancellation is started by a commissioner, any work paid for will belong to that commissioner, and the remaining amount equal to the uncompleted work will be refunded. If the piece is completed, or nearly completed, there will be no refund.

Example: Commissioner pays for full-color waist-up in full. After sketch approval, they need to cancel. Refund amount is the price of the commissions, minus the sketch.

Repeated requests for refunds may bar a commissioner from future commissions. Chargebacks will bar a commissioner.

If I have to cancel a commission for any reason, the commissioner will be fully refunded.

I reserve the right to issue a refund and cancel a commission for reasons including, but not limited to, poor communication, rude or inappropriate behavior, or history of abusive behavior toward artists.

 



Posting and Reposting Commissions

Commissioners are allowed to share the appropriately marked version of their commission on any site they see fit, unless I have posted it already, and it can be shared (as on Tumblr, Twitter, Pillowfort, etc). If a commissioner wants to repost on a site like FA, SoFurry, Weasyl, etc, then credit/link to my account must be included. You can see what sites I am on under the “About” section of this website.

If I feel a commissioner is abusing their reposting ability, I will request the image be removed. If this is ignored, I will take steps to have it removed with site management.

Adoptable characters have their own rules, and those are viewable on this page.

 


 

Copyright and Intellectual Property
Commissioners retain rights to their character/s. However, commissioners understand that their commissions may be used for future advertisements, posted to Gumroad, made into prints, or the like. Purchase of rights can be arranged, if this is not acceptable.

Commissioners are not granted the ability to do more than resize/crop their image for an icon. Color edits, sketch/ink finishing, etc must either come back to me for additional/continued fees, or be approved for another artist. Ignoring this rule will ban a commissioner from future commissions.

Unless paid for as a private commission, all commissions will be posted when/where I chose. I can leave a commissioner’s name off of the posting for no additional fee.

 


 

Work Schedule

I typically work in the order commissions are received, though smaller commissions, like icons, may move out of order. Additionally, I may work on what appears to be “personal” works between commission works.

I may stream commission works and/or record for later reposting to my YouTube and TikTok. If a commission is to be a “surprise,” you may ask that I not stream and delay posting recordings. Unless the commission has been paid for as private, I will not refrain from recording. I can leave the commissioners name off, if they with to remain anonymous.

Beyond the Horizon :: 5.21.23

Hi, yes, the project name has changed again. That link is a short update, and you can watch it in less than 6 minutes. But the tl;dr: Beyond the Horizon fits better so I’m changing to that. Additionally, since my last news update, a few characters have had name changes as well. Those are Illdria -> Arabella and Janus -> Apollo.

This is not a major update, other than I’ve added (I think) all missing art, project related or not, to the website. Additionally, I’m working on the layout and how you find things on here. Still in progress and I’m going to be bringing in assistance to make the site look better. I’m just… smooth-brained with WordPress layouts. I could barely figure out LiveJournal. lol
